New Update for Stamp 4 visa holders: Work Permit in Ireland gets easy

A good news for all the stamp 4 holders in Ireland as work permits get easy no matter the consequences. The Department of Enterprise Trade and Innovation recently posted an update regarding the application for  employment permits where applicants are the holders of a Stamp 4 permission to remain. 

Now the stamp 4 holder will not require an employment permit from the authority to work in the state. For some people circumstances may arise where a person may no longer be entitled to their Stamp 4 permission to remain, for example following the breakdown of a marriage, and may therefore wish to apply for an employment permit in order to continue to reside and work in Ireland. Individuals are required to submit the documents carefully to get a work permit if certain situations arise. 

Earlier, there were certain restrictions for the people who are on Stamp 4 visa as they had to go through long processes for employment permit. 

Here is what Stamp 4 means:

Stamp 4 is a type of stamp visa where the individuals get permission to stay in Ireland for a limited time, subject to conditions. When applying for citizenship by naturalisation Stamp 4 is reckonable as resident.

Some conditions:

  • You do not need an employment permit and can take up employment.
  • Individuals are allowed to conduct or operate a business in the state. 
  • You can work in a profession, subject to conditions of the relevant professional or other bodies.
  • As determined by the Government departments or agencies you can access the state funds and services as well.
  • If you wish to stay in Ireland past the expiry date of your immigration permission, you must apply to renew your permission and registration before they expire.

You may be given Stamp 4 if you have had permission to work in Ireland:

  • With a valid Critical Skills employment permit for 2 years
  • With a valid employment permit for 5 years
  • As a researcher (ie with a valid Hosting Agreement) for 2 years

You may be given Stamp 4 if you are granted permission:

  • To join your Irish spouse, civil partner or de-facto partner
  • To join your EU/EEA or Swiss family member based on EU Treaty Rights
  • To join a family member who has immigration permission based on Stamp 4EUFAM (ie EU Treaty Rights)
  • To join your family member who is a recognised refugee or has been granted subsidiary protection
  • To remain with your child who is an Irish citizen
  • Under the Investor and Entrepreneur Programme (including spouse/partner & family)
  • For Long Term Residence
  • As a convention or programme refugee, or based on subsidiary protection

Important things to note:

regarding applications for employment permits from Stamp 4 holders:

A person holding a Stamp 4 Permit may be required to provide the following additional information when applying for an Employment Permit:

  • An explanation as to why the non-EEA National is seeking to make an application for an employment permit.
  • Details of the non-EEA National’s current immigration status and a history of their engagement with the Department of Justice including the efforts they have made to renew of their Stamp 4 permission, or to seek to switch to an alternative permission i.e. Stamp 1.
  • Additional relevant information in support of the application.
